Welcome to Brain Awake. By downloading, accessing or using the Brain Awake application, you agree to these Terms of Use.

If you do not agree with these Terms, please do not use Brain Awake.

1. About Brain Awake

Brain Awake is a short cognitive warm-up application designed to help prepare users for mentally demanding activities such as study, work and other tasks requiring attention and focus.

Brain Awake provides a series of short interactive cognitive exercises.

2. Not Medical Advice or a Medical Device

Brain Awake is a general-purpose cognitive warm-up tool. It is not a medical device and is not intended to provide medical or healthcare services.

Brain Awake is not intended to diagnose, treat, cure or prevent any disease, medical condition, cognitive impairment or mental health condition.

Nothing provided through Brain Awake should be considered medical, psychological or other professional healthcare advice.

If you have concerns about your health or cognitive functioning, you should seek advice from an appropriately qualified healthcare professional.

3. Scores and Results

Any scores, results or performance information displayed during a Brain Awake session are provided only as part of the app experience.

Scores should not be interpreted as a measure or diagnosis of intelligence, cognitive health, neurological function or medical fitness.

Brain Awake does not currently store users' scores or results after the applicable session.

4. No Guarantee of Performance

Brain Awake is designed as a cognitive warm-up experience. Individual experiences may vary.

We do not guarantee that using Brain Awake will improve concentration, memory, cognitive performance, academic performance, workplace performance or performance in any other activity.

5. Appropriate Use

You agree to use Brain Awake lawfully and for its intended purpose.

You must not attempt to interfere with the operation or security of Brain Awake, gain unauthorised access to its systems, reverse engineer the application except where permitted by law, or use Brain Awake in a way that infringes the rights of others.

6. Intellectual Property

Brain Awake and its original content, design, graphics, exercises, branding and other intellectual property associated with the application are protected by applicable intellectual property laws.

Except where expressly permitted, these materials may not be copied, reproduced, modified, distributed or commercially exploited without permission.

7. Availability and Changes

We may update, modify, improve or discontinue features of Brain Awake from time to time.

We do not guarantee that Brain Awake will always be available or operate without interruption or errors.

8. Third-Party Platforms

Brain Awake may be downloaded or made available through third-party platforms such as the Apple App Store or Google Play.

Your use of those platforms may also be subject to their respective terms and conditions.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Brain Awake and its owner will not be liable for indirect, incidental, special or consequential loss arising from the use of, or inability to use, Brain Awake.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

10. Privacy

Your use of Brain Awake is also subject to the Brain Awake Privacy Policy, available on the Brain Awake website.

11. Changes to These Terms

These Terms of Use may be updated from time to time to reflect changes to Brain Awake, its features or applicable requirements.

The latest version will be published on the Brain Awake website with an updated effective date.
